Terms of Service

These Terms of Service (“Terms”) govern your use of rootslore.com and the RootsLore mobile applications (together, the “Service”). The Service is operated by Taeeun Kim, an individual based in Switzerland 🇨🇭 (“RootsLore”, “we”, “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
RootsLore is a tool for recording family history and viewing it as a family tree and an interactive map. The Service is provided free of charge and is offered on an “as is” and “as available” basis. Features may change, and we may add, modify or discontinue parts of the Service at any time.
2. Your account
You may begin using the Service without registering. You are responsible for any activity that occurs through your session or account and for keeping your access credentials secure.
3. Your content and responsibilities
- You retain ownership of the family data and other content you add (“Your Content”). You grant us the limited rights needed to store, process and display Your Content in order to operate the Service for you and the people you invite.
- You are responsible for the accuracy of Your Content and for having an appropriate basis to record information about other people, including living individuals. Do not upload content you do not have the right to share.
- You must not use the Service to store or share unlawful, infringing, harassing or otherwise harmful content, or to violate the privacy or rights of others.
4. Acceptable use
You agree not to:
- Reverse engineer, disrupt or attempt to gain unauthorised access to the Service.
- Use automated means to scrape or overload the Service.
- Misuse sharing features to access trees you were not invited to.
- Use the Service for any unlawful purpose.
5. Public trees and shared content
Some content on the Service is published as a public tree — a read-only genealogy made visible to anyone on the web at a public address. Public trees are reviewed and published by RootsLore, and may include historical lineages or notable public figures, as well as trees suggested or contributed by users.
When you suggest, submit or contribute content for a public tree, you confirm that:
- The information is already public — drawn from public records, published sources or facts the person has made public — and is not private, sensitive, confidential or contact information about a living private individual.
- You have the right to share it, and doing so does not infringe anyone’s privacy, publicity, reputation, copyright or other rights.
- For living people, you limit locations to a general area (for example, a city) and omit precise addresses, and you omit medical, financial and other sensitive details.
- Content based on fictional or other third-party works is shared as non-commercial reference only, and you will remove it at the rights holder’s request.
We do not verify user submissions and do not endorse their accuracy. We may edit, decline, unpublish or remove any public tree or contribution at our discretion, and we may revoke contribution or editing access at any time. If you believe a public tree contains information that is inaccurate, infringes your rights or should not be public, contact us using the details in section 14 and we will review it and, where appropriate, remove it.
6. Intellectual property
The Service itself — including its software, design and branding — is owned by RootsLore and protected by applicable law. These Terms do not grant you any right in our trademarks or other intellectual property except the limited right to use the Service as intended.
7. Third-party content and links
The Service may link to third-party websites. We are not responsible for third-party content, products or practices. Your use of third-party services is governed by their own terms.
8. Disclaimers
The Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that data will always be preserved. You are responsible for keeping your own copies of important information.
9. Limitation of liability
To the maximum extent permitted by law, RootsLore will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising out of or related to your use of the Service.
10. Consumer rights
Nothing in these Terms excludes or limits any rights you have as a consumer under the mandatory law of your country of residence. If you are a consumer in the EEA, the United Kingdom, Switzerland, Korea or a US state with applicable consumer-protection law, those protections apply in addition to these Terms and prevail to the extent of any conflict.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.
12. Governing law
These Terms are governed by the laws of Switzerland, without regard to its conflict-of-law rules, and the courts of Switzerland have jurisdiction over any dispute. This does not deprive you of the protection of mandatory consumer-law provisions, or of the right to bring proceedings in the courts, of your country of residence where such rights apply.
13. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above when we do. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
